To be eligible for a felony expungement, individuals must maintain a clean record for five consecutive years after completing their sentence. Once an individual becomes eligible, they may then file a petition with the Bayamón First Instance Court. At the court, the presiding judge will review the case and any objections from the Department of Justice, and then issue an order to expunge the file if there are no objections or if the objections do not stand.

Only individuals not listed on the Registry of Persons Convicted of Sex Offenses and Child Abuse, the Registry of Persons Convicted of Corruption, or the Registry of Persons Convicted of Violations of the Domestic Abuse Prevention and Intervention Act can file for an expungement.
